Terms of Use
These terms cover The Conditions Report app and this website, theconditionsreport.com. "We" and "us" mean The Conditions Report. By using the app or the site you agree to them. If you don't agree, please don't use the app.
The short version
- The app rates conditions, not safety. A Good rating or a call such as "Go surf" is our read of the forecast. It doesn't mean a spot is safe, or safe for you.
- You decide whether to go, and you accept the risks. Surfing, wind sports, hiking, skiing and snowboarding can injure or kill you, whatever the app says.
- We aren't liable if you're hurt or suffer a loss, as far as the law allows.

A guide, not a guarantee
Ratings and calls describe conditions, not safety. A rating of Good, Fair or Poor, a call such as "Go surf" or "Go hike", a "good until" time, and a notification that a spot has turned good are our read of what forecast and observation data suggest about conditions for a sport. None of them says that a spot is safe, or safe for you, and none of them replaces your own judgment about whether to go.
- The data can be wrong. We build reports from forecasts and observations published by others. Those can be inaccurate, late or missing, and so can our ratings. A forecast for an area can differ from what is happening at the spot, and conditions change quickly.
- The app doesn't know you. It knows nothing about your skill, experience, fitness, health or equipment, or who is with you.
- The app doesn't see most hazards. It doesn't measure or account for many dangers, such as rip currents, sneaker waves, rocks and other things in the water, water quality, avalanche danger, tree wells, falling trees or rock, trail damage, wildlife, closures, or other people.
- The app is not a safety or emergency service. Don't rely on it, or on its notifications, as your only source of weather warnings. Notifications can be delayed or fail to arrive, and the absence of an alert doesn't mean there is no danger.
Before you go, check official forecasts, warnings and local advisories, look at the conditions yourself, and know your own limits.
You accept the risks
Surfing, paddling, kiting, windsurfing, winging, hiking, running, riding, skiing and snowboarding are dangerous. They can cause property damage, serious injury and death, including when the app rates conditions as Good.
By using the app you agree that:
- you alone decide whether, where and when to go, and whether to carry on once you're there;
- you are responsible for your own safety, and for the safety of anyone who relies on your decision, such as children or people you bring with you;
- you voluntarily accept all the risks of these activities, and of relying on the app's ratings, calls, reports and notifications;
- to the fullest extent the law allows, you release us from, and agree not to bring, any claim for injury, death, loss or damage that arises from an activity you chose to do, whether or not you relied on the app in choosing it.
Your account
You must be at least 13 to use the app. If you're under 18, a parent or guardian must agree to these terms for you.
You can use the app as a guest or sign in with Apple, Google or email. Keep your sign-in details to yourself and give us accurate information. You can delete your account at any time from Profile in the app. Our Privacy Policy explains what we keep and why.
Acceptable use
Please don't:
- copy or collect the app's data in bulk, or by automated means;
- interfere with the app or our servers, or try to get into accounts or data that aren't yours;
- reverse engineer the app, except where the law says you may;
- use the app to break the law.
We may suspend or close an account that does these things.
Our content and other people's data
The app, its name and its mark belong to us. You may use the app for your own personal, non-commercial purposes.
- Weather forecasts, observations, alerts, buoy data and tide predictions come from the National Weather Service and NOAA. We aren't affiliated with or endorsed by either.
- Map data is © OpenStreetMap contributors, available under the Open Database License. Map tiles are served by OpenFreeMap, using the OpenMapTiles schema.
- The typefaces Archivo, Archivo Narrow and IBM Plex Mono are used under the SIL Open Font License.
Availability and changes
We may change the app, add or remove spots and regions, or stop offering the app. We'll try to give notice of a change that matters, but we can't promise the app will always be available or free of errors.
App stores
If you get the app from the Apple App Store or Google Play, that store's terms also apply to your use of it. Apple and Google aren't parties to these terms and aren't responsible for the app or for supporting it.
No warranty
The app and the site are provided "as is" and "as available", without warranties of any kind, whether express or implied, to the fullest extent the law allows. That includes any warranty of accuracy, merchantability, fitness for a particular purpose and non-infringement.
In particular, we don't warrant that any rating, call, report, forecast, tide prediction or alert is accurate, complete or current, that it suits your purpose, or that the app and its notifications will work without interruption or delay.
Limits on liability
To the fullest extent the law allows, we aren't liable for any injury, death, loss or damage arising from your use of the app, or from your reliance on its ratings, calls, reports or notifications.
- We aren't liable for any indirect, incidental, special, consequential or punitive loss.
- These limits apply to every kind of claim, including contract and negligence, even if we were told that the loss was possible.
- If we are found liable despite these terms, our total liability for all claims about the app is limited to the greater of the amount you paid us for the app in the 12 months before the claim, and US $50.
Some places don't allow some of these limits, so parts of this section may not apply to you. Nothing in these terms limits liability that the law says can't be limited.
Claims by others
If someone else brings a claim against us because of how you used the app, or because you broke these terms, you agree to cover our reasonable costs and losses from that claim, as far as the law allows.
If part of these terms doesn't apply
If a court finds that part of these terms can't be enforced, the rest still apply, and that part applies as far as the law allows.
Changes to these terms
When these terms change we'll update this page and the date at the top. Using the app after a change means you accept the new terms.
